pentru completarea art. 69! din Legea societăților nr. 31/1990

Parlamentul României adoptă prezenta lege

Art. I - La articolul 69! din Legea societăților nr. 31/1990, republicată în Monitorul Oficial

al României, Partea I, nr. 1066 din 17 noiembrie 2004, cu modificările și completările

ulterioare, se introduce un nou alineat, alin. (4), cu următorul cuprins:

„(4) Prin excepție de la dispozițiile alin. (3), rambursarea Împrumuturilor acordate societății de către asociați sau acționari nu este considerată repartizare sau distribuire de profit și este permisă chiar dacă activul net al societății este diminuat la mai puțin de jumătate din valoarea capitalului social subscris.”
